Why am I receiving these emails?

The Unsolicited Electronic Messages Act 2007 governs electronic communications, including what is known as spam. Spam is generally considered an ‘unsolicited commercial electronic message’. The law distinguishes between spam and essential service-related communications.

Under the Act:

1. Commercial Electronic Messages: These include electronic message that promotes or markets goods or services. Consent from the recipient is required to send these types of messages, and you must have the option to unsubscribe.

2. Service-related communications: Emails necessary for managing or maintaining an existing relationship with the customer, such as providing updates about their account or fulfilling legal or regulatory obligations, are exempt from the Act’s consent and ‘unsubscribe’ requirements. These are not considered “spam" if they are directly related to the service provided or are provided in order to meet legal or regulatory requirements.

There are certain communications that Generate must provide to you to meet its legal and regulatory obligations. This may include certain reports, Statement of Holdings and Tax Statements, notification of material changes to the Scheme, or other mandatory communications. These must be sent regardless of whether the recipient has opted out of marketing emails.
